Article 2 – Subject

The subject of this agreement is the rights and obligations of the parties regarding the sale and performance of the digital service ordered electronically by the Buyer, whose features and price are set out below.

Article 3 – Main features and price

The service lets printed images be recognized by a phone camera so that the matched video plays in the browser; it is a subscription bought per catalog. Prices include all taxes; the total amount payable is shown on the plans page before the payment step.

ImageWake is a digital service that plays videos through in-browser photo recognition for the duration of a subscription. A business can open several catalogs; each catalog is an independent subscription bought separately, with its own plan, period, address and QR code. Plans: Starter (10 items per catalog, 2,000 scans per 30 days; 990 TRY per month, 9,900 TRY per year), Professional (40 items per catalog, 10,000 scans per 30 days; 2,490 TRY per month, 24,900 TRY per year), Enterprise (150 items per catalog, 50,000 scans per 30 days; 5,990 TRY per month, 59,900 TRY per year). Other features of each plan are listed on the pricing page. A monthly payment gives 30 days of access, a yearly payment 365 days; in both cases the scan counter resets every 30 days. When a catalog's period ends only that catalog is closed. When the scan limit is reached, visitors may see a notice instead of videos until the end of the period. Upgrades take effect immediately and the catalog's remaining time is converted into days in proportion to the new plan's price; moving to a smaller plan starts at the end of the current period. When moving to a smaller plan existing content is not deleted; new content cannot be added above the limit. A deleted catalog's content is permanently deleted; its remaining time is not transferred to another catalog. Payments do not renew automatically. Access stops at the end of the period.

All prices are in Turkish lira (TRY) and payments are taken in TRY. Foreign currency amounts shown in other languages on this site are for information only and are approximate values calculated with the daily forex selling rate of the Central Bank of the Republic of Türkiye. For cards issued abroad, the conversion rate and any fees are set by the card issuer.

Article 4 – Payment

The total price is charged once, at the time of order, by credit or debit card through the secure iyzico payment infrastructure. The Seller neither sees nor stores card details. Payments do not renew automatically. Any discount coupon is reflected in the amount shown at checkout.

Article 5 – Performance and delivery

The service is performed electronically and instantly once payment is confirmed; the plan is applied to the catalog immediately and nothing is shipped. The service period is 30 days for a monthly plan and 365 days for a yearly plan. Details: Delivery and Returns

Article 6 – Right of withdrawal and refunds

The service is performed electronically and instantly within the meaning of Article 15(1)(ğ) of the Turkish Distance Contracts Regulation issued under Consumer Protection Law No. 6502. Because the catalog is activated as soon as payment is confirmed, there is no right of withdrawal; the buyer confirms this before purchasing. Law No. 6502 does not apply to buyers acting for commercial or professional purposes.

If the service cannot be provided for a technical reason attributable to us, the unavailable time is added to the catalog or, at the buyer's request, the corresponding amount is refunded. Refund requests can be sent to [email protected]; approved refunds are made to the card used for payment within 14 days at the latest. Consumers may apply to the consumer arbitration committees or consumer courts within the monetary limits announced each year by the Turkish Ministry of Trade.

Article 7 – Rights and obligations

The Seller undertakes to provide the service in line with the features stated in this agreement and on the site. The Buyer is responsible for the accuracy of account details and for account security.

The member confirms that they hold all necessary rights to the photos and videos they upload and that the content does not violate the law, public morality or the intellectual property and personal rights of third parties; the member is responsible for the content. Content that breaches these terms may be removed without notice and the account may be suspended. The member is responsible for keeping account credentials confidential and for all actions taken through the account.

Article 8 – Personal data

The Buyer's personal data is processed as described in the Privacy Policy: Privacy Policy

Article 9 – Force majeure

Neither party is liable for failing to perform its obligations due to force majeure beyond its control, such as natural disasters, epidemics, war or general power or telecommunication outages. Service time lost during such an event is added to the catalog once it ends.

Article 10 – Disputes

Disputes arising from this agreement may be brought before the consumer arbitration committees or consumer courts at the Buyer's or Seller's place of residence, within the monetary limits announced each year by the Turkish Ministry of Trade. For buyers acting for commercial or professional purposes, the courts and enforcement offices at the Seller's place of business have jurisdiction. This agreement is governed by Turkish law.

Article 11 – Entry into force

Before ordering, the Buyer confirms having read, understood and accepted electronically all articles of this agreement and the pre-contract information. The agreement enters into force when payment is confirmed. The agreement and order records are kept by the Seller and sent to the Buyer by email on request.
